Terms and Conditions

Last updated: September 2026

Welcome to Yang Tang Art. These Terms and Conditions apply to the use of this website and to purchases made through yangtangart.com.
By placing an order through this website, you agree to these Terms and Conditions.

  1. About Us
Yang Tang Art is an independent art business based in Malta, offering original artworks and art prints.
For enquiries regarding orders, payment, delivery, returns or your right of withdrawal, please contact:
    Email: info@yangtangart.com
Our geographical business address and withdrawal information are available on our Right of Withdrawal page.
  2. Artworks and Product Information
We make reasonable efforts to ensure that descriptions, dimensions, photographs and other information displayed on the website accurately represent each artwork.
Please note that colours may appear slightly different depending on screen settings, lighting and device display.
Original artworks are unique pieces unless otherwise stated. Prints and other editions may be offered in different sizes or formats as specified on the individual product page.
  3. Pricing and Payment
All prices are displayed in euros (€) unless otherwise stated.
Prices include applicable taxes where required.
Payment must be successfully completed before an order is processed, except where another payment arrangement is expressly offered, such as payment associated with local collection or delivery.
Available payment methods are displayed during checkout.
  4. Order Confirmation
After placing an order, you will normally receive an order confirmation by email.
An order is considered accepted once payment has been successfully processed and the order has been confirmed by us.
If an artwork becomes unavailable due to an error or other exceptional circumstance, we will contact you and refund any amount already paid for that unavailable item.
  1. Collection, Local Delivery and Shipping
Orders may be collected in Malta, delivered locally where this option is available, or shipped internationally, depending on the delivery options offered at checkout.
Orders are normally prepared for dispatch, collection or local delivery within the timeframe stated on our Shopping Information page.
For international shipments, delivery times may vary depending on destination, carrier and customs procedures.
Customers outside the European Union may be responsible for customs duties, import taxes or other charges imposed by the destination country. These charges are not included in the purchase price or shipping charge unless expressly stated otherwise.
Further information about collection, local delivery, international shipping and packaging is available on our Shopping Information page.
  1. Right of Withdrawal
Where applicable under EU and Maltese consumer law, consumers purchasing goods online have the right to withdraw from the contract without giving any reason within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
To exercise this right, the consumer must inform us of the decision to withdraw before the withdrawal period expires.
The withdrawal can be submitted through the Right of Withdrawal function available on this website. Consumers may also use the model withdrawal form provided on that page or contact us by email with a clear statement of their decision to withdraw.
The online withdrawal function and model withdrawal form are available through the Right of Withdrawal link in the website footer.
  2. Returns Following Withdrawal
After notifying us of a withdrawal, the goods must be returned without undue delay and no later than 14 days from the date on which the decision to withdraw was communicated to us, unless otherwise agreed.
Unless otherwise required by law or agreed by us, the customer is responsible for the direct cost of returning the goods.
Because artworks may be fragile, returned items should be securely and appropriately packaged to protect them during transport.
Consumers are responsible only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, in accordance with applicable law.
  3. Refunds Following Withdrawal
Where a valid right of withdrawal is exercised, we will reimburse payments received from the consumer, including the cost of the least expensive standard delivery option offered by us, in accordance with applicable law.
Additional costs resulting from the consumer choosing a more expensive or special delivery method are not required to be reimbursed.
We may withhold reimbursement until we have received the returned goods or until the consumer provides evidence that the goods have been sent back, whichever occurs first, where permitted by law.
Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.
  4. Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply where an exception provided by applicable consumer law applies.
In particular, this may include goods made to the consumer’s specifications or clearly personalised.
An artwork is not treated as excluded from the right of withdrawal merely because it is an original or unique artwork.
Where a particular product is excluded from the statutory right of withdrawal, this will be clearly indicated where appropriate before purchase.
  5. Damaged, Faulty or Incorrect Goods
The statutory right of withdrawal is separate from the consumer’s rights where goods are damaged, faulty, incorrect or otherwise not in conformity with the contract.
If an artwork arrives visibly damaged, please contact us as soon as reasonably possible at info@yangtangart.com and, where possible, provide photographs of the item and packaging. This helps us assess the damage and deal with the carrier where appropriate.
Nothing in these Terms and Conditions limits or excludes any mandatory statutory rights or legal remedies available to consumers under applicable law.
  6. Copyright and Intellectual Property
All artworks, photographs, images, text and other content displayed on this website remain protected by applicable copyright and intellectual property laws.
Purchase of an original artwork or print transfers ownership of the physical item only. It does not transfer copyright, reproduction rights or other intellectual property rights unless expressly agreed in writing.
Images of artworks may not be reproduced, distributed, commercially exploited or used to create derivative products without prior permission.
  7. Privacy
Personal information provided when using this website or placing an order is processed in accordance with our Privacy Policy.
Payment information is processed through the payment providers made available at checkout. We do not independently store complete payment card details.
  8. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes to our services, website or applicable legal requirements.
The Terms and Conditions applicable to an order are those made available to the customer at the time the order is placed, subject to mandatory consumer rights.
  9. Governing Law
These Terms and Conditions are governed by the laws of Malta, without prejudice to any mandatory consumer protection rights that may apply to consumers under applicable European Union or national law.
Nothing in these Terms and Conditions is intended to exclude, restrict or override rights that cannot lawfully be excluded or restricted.
